Thank you for visiting Luxe Proposal NYC Inc. (“Luxe,” “we,” “us,” or “our”). These Terms & Conditions govern the use of our website and provide general information regarding our proposal planning and related services.
By using our website, submitting an inquiry, or booking services with Luxe Proposal NYC Inc., you acknowledge and agree to these Terms & Conditions. Clients who book services with Luxe will also be required to review and sign a separate Client Service Agreement, which will govern the specific services provided for their event.
1. Services
Luxe Proposal NYC Inc. provides customized marriage proposal planning, design, and coordination services. Depending on the selected experience, services may include proposal planning, décor, setup and breakdown, floral arrangements, venue coordination, photography, videography, special effects, and coordination of third-party vendors.
All services, availability, designs, and pricing are subject to confirmation by Luxe.
2. Inquiries & Bookings
Submitting an inquiry through our website, email, telephone, social media, or other communication method does not reserve a proposal date.
A proposal date is considered reserved only after the required minimum 25% non-refundable retainer has been received and the Client Service Agreement has been signed.
Certain bookings may require a larger initial payment when Luxe must secure a venue, vendor, specialty item, custom product, or other service in advance.
3. Pricing & Payment
Pricing displayed on our website represents general pricing or investment ranges and may vary based on the client’s selected design, location, date, vendors, photography/videography, florals, special effects, customization, and other requested services.
The final price and included services will be confirmed with the client prior to booking.
The remaining balance for booked services is due no later than one (1) day prior to the scheduled proposal, unless otherwise agreed in writing.
Accepted payment methods may include Zelle, wire transfer, and cash.
4. Cancellations & Rescheduling
The minimum 25% booking retainer is non-refundable once the proposal date has been confirmed.
Certain third-party expenses, including venue fees, vendor deposits, permits, custom products, florals, rentals, and other committed expenses, may also be non-refundable once purchased or committed.
Weather-related changes and other qualifying unforeseen circumstances will be handled in accordance with the Client Service Agreement. Luxe will make reasonable efforts to adjust the time, location, or date when circumstances make the original plan impractical or unsafe.
5. Venues & Third-Party Services
Luxe may assist in locating, coordinating, booking, or retaining venues, photographers, videographers, florists, musicians, transportation providers, and other third-party service providers.
Availability and performance of third-party services may be subject to separate rules, restrictions, policies, and availability.
Public and private locations may also be subject to permits, venue policies, operating hours, weather conditions, government restrictions, and other requirements outside Luxe’s reasonable control.
6. Photography, Videography & Media
When photography or videography is included in a booked experience, delivery timelines, editing, usage rights, and other applicable terms will be provided in the Client Service Agreement.
Luxe may request permission to use photographs or videos from completed proposals for our portfolio, website, social media, advertising, and promotional materials. Clients may decline promotional use as provided in their Client Service Agreement.
7. Special Effects & Alcohol
Cold sparklers and other special effects are subject to applicable laws, venue policies, permits, safety considerations, and other restrictions. Luxe reserves the right to modify or discontinue any special effect that cannot legally or safely be performed.
Alcohol, where legally permitted and included, is subject to applicable laws and venue requirements. Alcohol will not knowingly be provided to anyone under 21 years of age.
Luxe does not knowingly provide proposal services to individuals under 16 years of age.
8. Website Content & Intellectual Property
The Luxe Proposal NYC name, branding, website design, written content, graphics, proposal designs, photographs, videos, and other original materials appearing on this website may be protected by copyright, trademark, and other intellectual-property laws.
Content owned by Luxe may not be copied, reproduced, distributed, modified, sold, or used for commercial purposes without prior written authorization from Luxe Proposal NYC Inc., except as otherwise permitted by law.
Third-party photographs, videos, music, trademarks, and other materials remain subject to the rights of their respective owners.
9. Website Information
We make reasonable efforts to keep information on our website accurate and current. However, photographs, descriptions, pricing, availability, locations, décor, florals, and other information are provided for general informational purposes and may change.
Images displayed on our website may represent previous events and are intended to demonstrate our style and capabilities. Because each proposal is customized, exact duplication of a previous design, floral arrangement, location appearance, or setup is not guaranteed.
10. Liability
Luxe exercises reasonable care in providing and coordinating its services. To the fullest extent permitted by applicable law, Luxe is not responsible for delays, interruptions, losses, or damages resulting from circumstances outside its reasonable control, including severe weather, venue closures or restrictions, government action, public interference, transportation disruptions, client or guest conduct, or acts or omissions of third parties outside Luxe’s control.
Specific responsibilities, limitations, and event-related terms applicable to booked clients are set forth in the Client Service Agreement.
Nothing in these Terms is intended to exclude or limit liability where doing so would be prohibited by applicable law.
11. Privacy
Information submitted through our website, including names, email addresses, telephone numbers, event information, and other personal information, will be handled in accordance with our Privacy Policy.
12. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict-of-law principles, except to the extent that mandatory laws of the jurisdiction in which services are performed apply.
13. Changes To These Terms
Luxe Proposal NYC Inc. may update these Terms & Conditions periodically. Updates will become effective when posted to this website. The “Last Updated” date at the top of this page will reflect the most recent revision.
